Terms of Use

 

This Agreement is an electronic contract that establishes the legally binding terms you must accept to be able to use the website and/or create an account with our website. The website is operated by and the data collected processed by the registered association ΠΑΓΚΥΠΡΙΟΣ ΑΘΛΗΤΙΚΟΣ ΣΥΝΔΕΣΜΟΣ ΙΔΙΟΚΤΗΤΩΝ ΜΙΚΡΩΝ ΣΚΑΦΩΝ (ΠΑ.Σ.Ι.ΜΙ.Σ) (PASIMIS) registered in Cyprus with registration number 2020 and registered address at 2 Lysandrou Street, 2007 Strovolos, Nicosia, Cyprus (hereinafter referred to as the “Association” or “us” or “we”).

 

By accessing our website and/or creating an account with our website (hereinafter referred to as our “Services”) you (hereinafter referred to as a “User” or “you”) agree to be bound by these Terms of Use and our Privacy Policy which is incorporated by reference into this Agreement and available through our Service (this “Agreement”) and as has last been updated on 30th March 2022. 

 

Such documents constitute the agreement between any User and the Association and are drafted in accordance with the laws and regulations of the Republic of Cyprus (hereinafter collectively referred to as the “Applicable Law”) and outlines our practices regarding the processing of any information relating to an identified User who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier of that natural person (hereinafter referred to as “Personal Data”).

 

By accessing the Services you agree to be bound by these Terms of Use as stated in this Agreement. You shall only be permitted to create an account with our website by using your real Personal Data upon completing our Membership Registration Form and subsequently constituting a User (hereinafter referred to as your “Account”). You are prohibited from using any other User’s profile to use the Services. Please consult our Privacy Policy which indicates the Personal Data we collect, process, distribute and share with our third party processors. 

 

IF YOU DO NOT UNDERSTAND OR DO NOT AGREE TO THESE TERMS OF USE AND OUR PRIVACY POLICY, DO NOT USE THE SERVICES AS UNAUTHORIZED USE IS STRICTLY PROHIBITED AND SUCH USE OF THE SERVICES IS VOID.

 

You must be at least 18 years of age to access and use the Services. Acting as a User of an Account, you represent and warrant that you are not a person who is barred from using the Service under the Applicable Law or impersonate or disseminate another person’s information without his or her permission, including but not limited to not acting as the legal guardian of a minor, and you will comply with this Agreement and the Applicable Law. 

 

Any Account must contain your accurate Personal Data such as name, surname, date of birth, nationality, email address, address, telephone number, and medical conditions and contact person, where applicable. Any User is at all times responsible to proceed with any amendment and/or update and/or completion of such data which should be promptly notified to the Association through updating of the profile and address tabs of any Account.

 

You can register as a User by completing and submitting the online Membership Registration Form which is further subject to review and approval by the Club’s Board prior to granting of authorized access to an Account to any User. 

 

Personal Data collected in this manner are collected, processed, distributed and shared with our third party processors as indicated in our Privacy Policy. We undertake any reasonable measures to ensure that the Personal Data provided by Users are accurate, however, we assume no responsibility in any manner for the validity of the Personal Data provided by any User at any time. 

 

The Association reserves the right to investigate, suspend and/or terminate any Account if any User misuses the Services or behaves in a way the Association regards as inappropriate or unlawful, including but not limited to the non-payment of outstanding orders within any Account. The Association is not required to disclose and/or may be prohibited by the Applicable Law from disclosing, the reason for the termination or suspension of your Account. After your Account is terminated or deactivated for any reason, all terms of this Agreement survive, and continue in full force and effect, except for any terms that by their nature expire or are fully satisfied.

 

Users may access their Account and proceed with the order and payment of any provided Service at any available time. Orders shall be placed and duly paid subject to your acceptance of this Agreement and our Privacy Policy. Payment by cash to the instructors of the Association or by Direct Bank Transfer are subject to the approval by the Association as to confirmation of receipt of payment. Completion of any payment via JCC Payment Systems shall automatically revert with a notification of your payment and your order shall be updated as to its payment. The Association reserves the right at any time to reject any order and refund any payment for any order and/or service which may be suspended and/or postponed and/or cancelled for any reason which may or may not be notified to you. 

 

Users may access their Account and proceed with the cancellation of any order at any time. Annual fees shall cease to renew upon expiration at the end of any calendar year and monthly fees shall expire at the end of the month within which the cancellation had been notified to the Association through your Account. Cancellation of any seminars and request for a refund can only be performed at least a calendar week in advance of the advertised date of any seminar. Cancellation of Annual Memberships shall also terminate any access to your Account and Active Membership Privileges upon expiration at the end of any calendar year and the Association reserves the right to charge any User for the reactivation of any such Account, if such is requested by any User at any time. 

 

Annual and monthly fees are not refunded by the Association and any cancellation by you shall only be effected in relation to the renewal of such fees. A refund may be provided by the Association upon cancellation of any seminars you have notified through your Account at least a calendar week in advance of the advertised date of any seminar. You are responsible for maintaining the confidentiality of your Account information and you are solely responsible for all activities that occur under your profile. You agree to immediately notify the Association of any disclosure or unauthorized use of your Account or any other breach of security at info@pasimis.com. 

 

The Association owns and retains all proprietary rights in the Services, and in all content, trademarks, trade names, service marks and other intellectual property rights related thereto. The Services contain the copyrighted material, trademarks, and other proprietary information of the Association and its licensors. You agree to not copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, trademarks, trade names, service marks, or other intellectual property or proprietary information accessible through the Services, without first obtaining the written consent of the Association and if such property is not owned by the Association, you additionally have to obtain the written consent of the owner of such intellectual property or proprietary rights. 

 

You acknowledge that use of the Services is at your own risk. To the fullest extent allowed by Applicable Law, in no event will the Association, its officers, directors, employees, agents, affiliates, business partners, licensors or service providers be liable to you or any third  person or legal entity for indirect, incidental, special, punitive or consequential damages or injury arising out of the use or inability to use the Services or out of the breach of any warranty, or caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to and/or alteration of the Services. This is regardless as to whether such claims are based in contract, tort, negligence, strict liability or any other cause of action and/or whether the Association has been advised of the possibility of such damages.

 

The Services may contain, and the Services or third parties may provide, advertisements and promotions offered by third parties and links to other websites or resources. You acknowledge and agree that the Association is not responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any content, information, statements, advertising, goods or services, or other materials on or available from such websites or resources. 

 

We reserve the right to modify the Terms of Use at any time, in our sole discretion, with or without notice. The modified Terms of Use shall be made publicly available on the website. By continuing to use the Services you agree to the newest version of the Terms of Use and you accept to be bound by the latest Terms of Use that govern it. If you don’t agree to be bound by the modified Terms of Use, you must stop using the Services and inform us immediately as to the withdrawal of your consent. You agree that the Association shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.
